Our agency contracts with county household hazardous waste (HHW) operations or other entities to offer the collection of agricultural waste pesticides. As per these agreements the entities must follow the collection requirements included in state statutes.

2022 Cooperative Agreement: Vaccine Language

The Minnesota Department of Agriculture (MDA) has received many questions on the vaccine language in the recently emailed draft Waste Pesticide Cooperative Agreements. The policy does not apply to: outdoors construction, maintenance, or service contracts; Indoors work in unoccupied spaces (including, for example, work on a floor not concurrently occupied by employees or the public);  service performed during non-standard business hours; and services where the provider will be on-site fewer than 10 minutes. Most waste pesticide agreements fall into that category and are, therefore, exempt. If you have any questions, please contact Jane Boerboom (Jane.Boerboom@state.mn.us, 651-201-6540) or Kam Carlson (Kameron.Carlson@state.mn.us, 651-210-5881).

NOTE: the following addition to Clause 17.1 has been updated to include the bolded language.  All agreements will include that language in the final version sent for signatures.

  1. Applicability. This section applies to Governmental Unit’s employees or subcontractors who are performing contracted work in the following types of project settings for more than 10 minutes: indoors with regular in-person contact with State agency employees or members of the public; and outdoors with substantial and/or regular in-person, non-socially distanced contact with State agency employees or members of the public (“Covered Individuals”).

Required Forms

Specific forms are required to record the weight or estimated weight of collected agricultural (ag) pesticides. Disposal of ag pesticides is costly. Participants are allowed to drop off 300 pounds of ag pesticides for free. Any amount above this limit is subject to a disposal fee. Use the disposal charge form below to get participant approval before accepting the material.
